Sexual abuse is a common sex crime charged within the State of Alabama, and one of the charges our sex abuse lawyers at Parkman White, LLP have experience defending.

Sexual abuse describes conduct where the alleged offender is accused of touching another person in a sexual manner.  If the sexual contact results in forcible intercourse, the defendant would likely be charged with rape rather than sexual abuse.  Likewise, if the sexual contact resulted in contact between the mouth and the genitals or the genitals and the anus, Sodomy would be the charge rather than sexual abuse.

There are two forms of sexual abuse:  sexual abuse in the first degree and sexual abuse in the second degree.  Our Birmingham sexual abuse attorneys are experienced in defending both types of crimes.

SEXUAL ABUSE FIRST DEGREE

Sexual abuse 1st is outlined in Alabama Code 13A-6-66.  Sexual abuse I occurs when one person subjects another person to sexual contact who is incapable of consent, or by forcible compulsion.  Sexual abuse I is treated as a Class C felony, meaning those that are convicted could face up to ten years in state prison.

SEXUAL ABUSE SECOND DEGREE

Sexual abuse 2nd is codified in Alabama Code 13A-6-67 and covers sexual contact on a person who is incapable of consent by reason other than being less than 16 years old, or to a person older than 19 who sexually abuses a person between the ages of 12 and 16.  Sexual abuse in the second degree is a Class C felony subjecting those convicted up to 10 years in prison, as well as required registration as a sex offender.

SEXUAL ABUSE OF CHILD LESS THAN 12

The punishment is enhanced under Alabama Code 13A-6-69.1 for those defendants above the age of 16 who are accused of subjecting a child under the age of 12 to sexual contact.  In such a case, the punishment is enhanced to a Class B felony, making punishment up to 20 years in prison possible.
